Abstract

The section explores the concepts, legal foundations of the modern and inevitable process of digitalization, which is rapidly developing in all democratic and socially oriented states of the world. In this work, the state is considered as a social institution through the prism of its interaction with civil society, some criminal justice bodies (for example, pre-trial investigation bodies and probation bodies). The following conclusions were made during the study: 1) the term «digitalization» means the process of converting a variety of information in all its forms – text, sound, graphics – into a digital format understandable to modern gadgets, providing transparency and accessibility in obtaining the necessary information and services; 2) the European choice of Ukraine requires bringing domestic legislation to the norms and principles of the European Community, it is associated with the need for further development and implementation of regulatory legal acts aimed at regulating the status of subjects of information relations on the Internet, establishing the grounds for their responsibility, creating appropriate conditions for cybersecurity; 3) the formation of a modern digital state is associated with the need to develop and implement a consistent state information policy, which should be based and implemented in a clearly defined legal field; 4) a digital state is a state whose functions and tasks are implemented under the means of information and communication technologies; 5) the information society is an integral part of the modern political system, which is a post-industrial new phase in the development of society, where the production, use and consumption of information becomes the determining way of activity in all spheres of social life (economy, politics, culture, etc.); 6) an important role in the process of digitalization belongs to the criminal justice authorities. By applying the latest technologies, namely, complex computer programs, the so-called «smart system» – electronic criminal proceedings, it will be possible to simplify the work of law enforcement agencies and improve the quality of protection of citizens’ rights, etc.; 7) an important role in the prevention of crime and the protection of the rights and freedoms of citizens belongs to the State Institution «Probation Center» of the Ministry of Justice of Ukraine and its subordinate authorized bodies on probation issues, which are entrusted with the implementation of supervision and social and educational measures in relation to probation subjects. The assessment of the risks of committing a repeated criminal offense is a powerful innovative tool in the work of probation staff with the gradual introduction and installation of The Unified Register of Convicts and Persons of Convicts, etc. Ukraine is a modern and progressive state that reasonably approaches various challenges and goes its own way of development, using the latest means of modernizing the state and its bodies for better and more transparent interaction with civil society.
